Rental Terms & Conditions

THIS AGREEMENT is entered into between Dive Rutland Limited and ……………………………….……………...………  ‘the Hirer’ for the rental of scuba and / or skin diving equipment.

This AGREEMENT is a release of the Hirer’s rights to sue for injuries or death resulting from the rental and / or use of this equipment.  The Hirer expressly assumes all risks of skin and / or scuba diving related in any way to the rental and / or use of this equipment.

The equipment on hire shall always remain the full legal and absolute property of Dive Rutland Limited (‘The Company’) that trades as Dive Rutland.

The Hirer acknowledges that the equipment is in good working condition, has been trained how to check that the equipment being hired is in full working order and that they have examined the equipment to ensure that it is free from defects, including checking both the quality and quantity of air in any scuba cylinder(s) rented.

The Hirer also understands that Dive Rutland Limited and its employees, owners, officers, or agents (hereinafter ‘Released Parties’), shall not be held liable or responsible in any way for any injury, death or other damages to the Hirer or his family, heirs, or assigns which may occur as a result of the rental and / or use of the equipment, or as a result of product defect, or the negligence of any party, including the Released Parties, whether passive or active.

The Hirer agrees to reimburse Dive Rutland Limited for the loss or damage of any and all equipment at the current replacement value and to also pay for damages incurred while transporting the equipment.

It is the Hirer’s responsibility to arrange insurance of the hired equipment during the period of the hire.  This insurance must cover the full cost of replacement or repair in the case of Theft, Loss or any type of Accidental or consequential Damage however caused.

If the equipment is lost, stolen or damaged whilst on hire, the Hirer will be held fully responsible and any loss or damage will be charged for in full, without exception.

The Hirer must treat the equipment in accordance with manufacturers and Dive Rutland Limited best practice and recommendations.

If the Hirer is not a fully paid Club Member or registered as a Dive Rutland Pay As You Go member and therefore unknown to The Company, two forms of personal identification must be provided prior to hiring equipment (i.e. passport, driving license)

The Hirer MUST be in possession and SHOW the relevant qualification to hire equipment at the time of hire e.g. Hiring of Drysuit MUST show a DrySuit Speciality card.

In the event of late return of the equipment without previous authorisation the hire will be charged at the standard day rate.

Hire charges will be invoiced at point of booking - No refund will be given for non-use of the equipment during your hire period.

The Hirer shall at all times fully indemnify The Company against all actions, costs, claims, legal proceedings and liability from the associated use of the hired equipment.  The Company will accept no responsibility for any legal action on behalf of the Hirer’s use of the hired equipment.

Damage incurred during delivery must be reported immediately.  The equipment is checked and approved prior to hire and The Company accepts no responsibility for loss or inconvenience caused by faults encountered during hire.

The Hirer agrees to reimburse the cost of any loss that occurred during the hire at the current market value.

The Hirer will ensure PRIOR to returning:-

       All equipment is cleaned and rinsed in fresh water – charges will be applied for equipment returned in a non-clean state.

       The regulator dust cap is DRIED and REPLACED prior to returning.  IF the dust cap is not dried and replaced AND water ingress is found to have occured to the first stage, a service will be undertaken and charged for;

       Weights are removed from BCD’s and Weight Belts;

       BCD straps are reconnected, shoulder straps are shortened, cumberband is done up, waist strap is done up and shortened, weight pockets are in place;

Cylinder:

       When you hire a cylinder, you are entitled to the air that comes with it, any additional cylinder fills are the responsibility of the Hirer;

       Cylinders with a pink PADI band are A-Clamp;

       Cylinders with a purple or Black PADI band are DIN Fitting;

       The orange band or Orange insert cap MUST be removed after use and placed in the container on the VAN or returned to the shop as they are used to indicate they are no longer full;

       A green PADI band indicates the cylinder is a nitrox cylinder.  This has two purposes, one you MUST be nitrox qualified and analyse your air prior to use and declare the mix to surface support and do not forget to set your computer to the right mix!  This band MUST stay on the cylinder, only remove the purple or pink band

The equipment will be collected or packed into the appropriate container provided at Dive Rutland Limited, Unit 2B Station Approach, Oakham, Rutland LE15 6QW

The equipment is for the use of The Hirer only.

AND UNDERSTAND THE ABOVE AGREEMENT. BY SIGNING THIS AGREEMENT,

AGREE THAT I AM SIGNING TO ACCEPT THE TERMS AND CONDITIONS AS LAID OUT ABOVE.  

I EXEMPT AND RELEASE Dive Rutland Limited AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH AS A RESULT OF RENTING AND/OR USING THE EQUIPMENT, HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE.
